The Auteursverordening (Copyright Ordinance) of Aruba is derived from the Dutch Auteurswet 1912 and was in force on 1990-01-01 as part of the legal framework inherited at Status Aparte (1986). The exceptions and limitations in Chapter I ยง 6 include: (1) a press exception allowing reproduction of news articles unless expressly reserved (Art. 15); (2) an educational/scientific exception permitting use of 'short fragments' (korte gedeelten) of copyrighted works for educational or scientific purposes (Art. 16); (3) a private-copy exception permitting a small number of copies for 'private study' (eigen oefening, studie of gebruik) โ but this is limited to 'small parts' or 'short passages' of works, not full works (Art. 16b); (4) a panorama exception (Art. 18); (5) a quotation exception. No exception permits reproduction of full works for research purposes. The educational/scientific exception is limited to 'short fragments' (korte gedeelten). The private-study exception similarly does not authorize full-work reproduction โ it is modeled on the pre-amendment Dutch law which limited private copying to short excerpts. There is no fair use, fair dealing, general three-step-test enabling clause, TDM exception, or library/institutional exception that would permit full-work reproduction. The most permissive research-relevant exception caps reproduction at short excerpts/fragments, which maps to RED. Classification-neutral factors (non-commercial purpose, number of copies) were not factored into the color decision.

As of 2025, the Auteursverordening of Aruba has not been amended to add any TDM exception, general fair use/fair dealing clause, library/institutional exception, or broader research exception. The law remains based on the pre-1997 Dutch Auteurswet model. The most permissive research-relevant exceptions are: (1) Art. 16 โ educational/scientific use of 'short fragments' only, not full works; (2) Art. 16b โ private copying for study limited to short passages, not full works; (3) Art. 15a โ quotation exception limited to quotations. None of these permit reproduction of full works for any type of work. The Wikipedia article on the Auteursverordening confirms: 'It is permitted to use short fragments of copyrighted works for educational or scientific purposes' and 'It is permitted to make a small number of copies for private study.' The panorama exception (Art. 18) is not relevant to research copying of literary/scientific works. Aruba is not an EU member state and is not subject to EU copyright directives. No subsequent amendments to the exceptions provisions have been identified through web search of the Government of Aruba gazette pages or WIPO Lex. The classification is RED because no provision permits a researcher to reproduce a complete work of any type โ the ceiling is always short excerpts/fragments. Classification-neutral factors (non-commercial restriction, copy limits) were not factored into the color decision.
