Current rationale

As of 2025, the Brazilian Copyright Law (Law 9.610/1998, as amended) remains in force with no changes to the exceptions and limitations relevant to research. The amendments made by Law 12.853/2013 concerned collective management of copyright (ECAD reform) and did not alter Art. 46. Provisional Measure 907/2019 (later converted into Law 14.010/2020 and related measures) addressed accessibility for persons with disabilities but did not broaden the general research or private copying exceptions. Art. 46(II) still limits private copying to 'pequenos trechos' (small excerpts) in a single copy. Art. 46(III) permits citation of 'passages' for study purposes. There is no fair use, fair dealing, general research exception, library/institutional exception, or TDM exception in Brazilian law. Brazil has no provision permitting full-work reproduction for research purposes for any type of work. The ceiling for any research-related copying remains 'small excerpts' or 'passages,' which maps to RED. Classification-neutral factors (non-commercial restriction, single-copy limit) were not factored into the color decision.

Art. 49(II) of Law 5.988/1973 permits reproduction of any work, in a single copy, provided it is not for profit. This is a private-use exception (single copy, no profit) that covers full works and all types of works, but is limited to reproduction only (no sharing/communication) and implicitly to individual/private use. There is no general fair use, fair dealing, or institutional research exception. Art. 49(I)(a) only covers excerpts ('trechos') in the context of a larger scientific work, which is a quotation-type exception (RED individually). The most permissive exception is Art. 49(II), which permits full-work reproduction by any individual for non-profit purposes — this maps to LIGHT BLUE (reproduction of full works, any work type, but restricted to private/personal use, no sharing). The non-commercial restriction is classification-neutral, and the single-copy limit is classification-neutral.

Why this score

Law 9.610/1998 replaced Law 5.988/1973 and significantly narrowed the private copying exception. The former Art. 49(II) permitted reproduction of 'any work' in a single copy without profit. The new Art. 46(II) restricts reproduction to 'pequenos trechos' (small excerpts) only, in a single copy, for private use of the copier, without profit. This is a critical change: no provision now permits full-work reproduction for research. Art. 46(III) is a quotation exception limited to 'passages' (passagens) for study, criticism, or polemic — also limited to excerpts. Art. 46(I)(d) permits full reproduction but only for visually impaired persons, not for research generally. There is no fair use, fair dealing, general research exception, library exception, or TDM exception. The most permissive research-relevant exception is Art. 46(II), which caps reproduction at 'small excerpts' — this maps to RED. The single-copy and non-commercial restrictions are classification-neutral, but the 'small excerpts' limitation is the determinative factor.
