For 2014, the active event in this file is Accord de Bangui révisé du 24 février 1999 (Annexe VII – Droit d'auteur).

?

Current rationale

Burkina Faso is a member of OAPI (Organisation Africaine de la Propriété Intellectuelle). The revised Bangui Agreement of 24 February 1999 (Annex VII on Copyright) replaced the 1977 Bangui Agreement and became the directly applicable copyright law in OAPI member states. It entered into force on 28 February 2002. Annex VII contains exceptions and limitations provisions. However, the full verbatim text of the relevant exception articles could not be retrieved and verified via web search during this session. The Bangui Agreement is directly applicable in Burkina Faso without need for national transposition. Classification remains AMBIGUOUS because the verbatim text could not be confirmed.

Exceptions considered

Annexe VII, Art. 11-13 (presumed)?Private UseMost permissive

Presumed exceptions including private reproduction, quotation, and possibly educational/research use under the revised Bangui Agreement, but text not verified

Why this score

The baseline copyright law in force on 1990-01-01 in Burkina Faso was the Zatu an VII 0013/FP/PRES of 16 November 1989 on literary and artistic property. This law entered into force in 1989. WIPO Lex lists this law but the full statutory text could not be retrieved or verified via web search. The WIPO Lex record indicates the law contains exceptions and limitations provisions (Articles 16-17 are typically the relevant exception articles in Francophone African copyright laws of this era, modeled on the Bangui Agreement of 1977/1999). Without access to the verbatim text, the precise scope of exceptions for research, private use, or quotation cannot be confirmed. Classification is therefore AMBIGUOUS due to inability to verify the statutory text, not due to textual indeterminacy.

Exceptions considered

Art. 16-17 (presumed)?Private UseMost permissive

Presumed exceptions for private use and quotation, based on typical Francophone African copyright law structure of this era, but text not verified

Why this score

Law No. 032-99/AN of 22 December 1999 is the national copyright law of Burkina Faso that complements the Bangui Agreement. Article 19(1) permits reproduction, translation, adaptation, arrangement or other transformation of a lawfully published work exclusively for the private use of the user ('exclusivement pour l'usage privé de l'utilisateur'). This covers reproduction of full works for private use, which includes private study and individual research. However, it is restricted to 'private use' of the individual user, meaning it does not authorize sharing, communication, or institutional use. Article 19(2) permits quotation only. Article 19(3) permits use for teaching illustration but not specifically for research. There is no general fair use, fair dealing, or specific research exception beyond the private use provision. There is no TDM exception. There is no library/institutional exception for research. The most permissive exception for research purposes is Art. 19(1) — private use covering reproduction of full works of any type by any individual user, but restricted to private use only (no sharing). This maps to LIGHT BLUE: reproduction of full works permitted, but restricted to individual/private use, no sharing authorized. The non-commercial nature of private use is a classification-neutral factor and was not considered in the color assignment.

Exceptions considered

Dates: Effective 2022-03-14 · Enacted 2015-12-14

Why this score

The Bangui Agreement was revised again on 14 December 2015. The revised Annex VII on copyright and related rights entered into force in OAPI member states. The 2015 revision modernized certain provisions but the exception articles (Art. 24-25 of the revised Annex VII) maintain a structure similar to the 1999 version, including private use exceptions and quotation rights. However, the full verbatim text of the 2015 revised exception articles could not be retrieved during this search session. Based on the structure of the OAPI framework and the continuing national law (Loi n°032-99/AN), the classification remains LIGHT BLUE. The national law's Art. 19(1) private use exception remains the most permissive provision for research purposes. No TDM exception has been introduced.

Why this score

As of 2025, the copyright law in force in Burkina Faso consists of the national Law No. 032-99/AN of 22 December 1999 and the revised Bangui Agreement (Annex VII). No new national copyright law or amendment introducing a research-specific exception, fair dealing/fair use clause, TDM exception, or library/institutional exception has been identified. The most permissive exception for research purposes remains Art. 19(1) of the national law, which permits reproduction, translation, adaptation, arrangement or other transformation of a lawfully published work exclusively for the private use of the user. This covers full works of any type but is restricted to private/individual use only. No sharing or communication is authorized. No institutional exception for research exists. No TDM exception exists. This maps to LIGHT BLUE: reproduction of full works of any type is permitted, but only for private use of the individual user, with no authorization for sharing or institutional use. Classification-neutral factors (non-commercial restriction, lawful publication requirement) were not considered in the color assignment.
