On 1990-01-01, Bosnia and Herzegovina was part of the Socialist Federal Republic of Yugoslavia (SFRY). The applicable copyright law was the SFRY Copyright Act of 1978 (Zakon o autorskom pravu, Official Gazette SFRJ No. 19/78, amended 21/90). I was unable to retrieve the full statutory text of this law via web search to verify the specific exceptions and limitations relevant to research. The SFRY law was known to contain a private-use exception and quotation provisions, but without verified statutory text I cannot classify the color with confidence.

Article 45 - It shall be permitted, without the author's consent and without payment of remuneration, to reproduce and distribute parts of a work (quotations) in the form of illustration in a publication, broadcast or sound or visual recording for the purpose of criticism, polemic, review, teaching, science or art, in accordance with fair practice and to the extent justified by the purpose to be achieved. Article 46 - It shall be permitted, without the author's consent and without payment of remuneration, to reproduce a work for the purpose of a judicial or other official procedure and for the purpose of public security. Article 47 - It shall be permitted, without the author's consent and without payment of remuneration, to reproduce a work for the purpose of teaching, provided that the source and the name of the author are indicated. Article 48 - Libraries, archives, museums and other public institutions may, without the author's consent and without payment of remuneration, reproduce a work from their own collections for the purpose of protecting and preserving the work.

Article 53 provides for private-use reproduction but now explicitly EXCLUDES: (a) reproduction of the whole or a substantial part of a written work, (b) sheet music, (c) electronic databases, (d) computer programs, (e) architectural works. This means private-use reproduction of full works is permitted for some categories (e.g., audiovisual works, sound recordings, visual art) but NOT for written works, sheet music, databases, software, or architecture. This is a narrowing from the 2002 law. Article 54 permits quotation of excerpts only (RED individually). Article 57 permits reproduction and distribution for teaching (not explicitly research). Article 59 permits library reproduction for preservation only. There is no general fair use/fair dealing clause, no TDM exception, and no open research exception. The most permissive exception for research remains Article 53 (private use), which now permits full-work reproduction for some types of works but excludes written works and several other categories. Since full-work reproduction IS permitted for at least some types of works (e.g., audiovisual, sound recordings) but NOT for all types (written works are excluded), this maps to ORANGE. As of 2025, the 2010 BiH Copyright Act remains in force. No subsequent amendments affecting the research-relevant exceptions (Articles 53, 54, 57, 59) have been identified. The classification remains ORANGE for the same reasons as the 2010 event: Article 53 permits private-use reproduction of full works for some categories (audiovisual, sound recordings, visual art, etc.) but explicitly excludes written works (whole or substantial part), sheet music, databases, software, and architectural works. There is no general fair use, fair dealing, TDM, or open research exception. Article 54 (quotation) is limited to excerpts. Article 57 (teaching) does not explicitly cover research as a standalone purpose. Article 59 (library preservation) does not cover research lending. The most permissive exception for research remains Art. 53, which permits full-work reproduction for some but not all types of works, yielding ORANGE. Non-commercial restrictions and copy limits are classification-neutral. BiH is not an EU member state, so EU directives (including the DSM Directive with TDM exceptions) have not been transposed.
